Probate Litigation
Probate litigation pertains to legal proceedings that are associated with contesting a Will, disputing a Trust, claims of breached fiduciary duties, addressing incapacity or undue influence, securing property that was wrongfully taken, and more. We represent heirs, trustees, executors, estate administrators, personal representatives, and other interested parties in probate litigation matters such as, but not limited to, Will and Trust contests and disputes, Trust termination, and Breach of Fiduciary Duties.
Trust Litigation
A trustee has a legal obligation to follow the provisions and instructions set forth in a Trust and to properly handle the assets of that Trust. Beneficiaries have certain rights when it comes to reviewing the performance of the trustee, and to challenge any actions that may have an impact on their interests and/or the Trust assets.
Trust Litigation allows Beneficiaries to obtain transparency regarding the conduct by a Trustee, to challenge any decisions that depart from the terms of the Trust, and to get relief for any harm caused. Claims may be brought against the Trustee for mismanagement or misappropriation of Trust assets, fraud, and breach of fiduciary duties.
Estate Litigation
An estate’s Personal Representative or Executor has a legal duty to follow all provisions and/or instructions set forth in a Will or, if there is no Will, as provided by law. They are required to handle all Estate assets in an equitable, honest, and competent manner. If that individual fails in their legal obligations to the Estate, claims may be brought against them on the grounds of breach of fiduciary duty, fraud, mismanagement or misappropriation of assets, and more.
Business Litigation / Arbitration
Business litigations law involves disputes stemming from business and commercial related transactions. Business litigation attorneys defend or work to resolve legal disputes between businesses and other parties. Business litigation includes a variety of legal issues, including breach of contract, real estate disputes, intellectual property, and employment. In many cases, these types of disputes can be resolved quickly without having to go to court which, in turn, significantly reduces the cost to both parties as well as the stress of having to go through a court trial. General Civil Litigation
The term “civil litigation” is applicable to any legal dispute in which two or more parties are seeking monetary damages or a specific outcome that does not involve criminal charges or penalties. In a civil litigation case, one party, the “plaintiff”, is seeking some form of compensation or other legal remedy from the “defendant”.
